Acceptable Use Policy

Guidelines for using Zovela responsibly

1. Introduction

This Acceptable Use Policy (“AUP”) governs your use of the Zovela website, platform, and services (collectively, the “Services”) provided by Zovela (“Zovela,” “we,” “our,” or “us”). This AUP is incorporated into and forms part of our Terms of Service.

By using the Services, you agree to comply with this AUP. We reserve the right to modify this AUP at any time, and your continued use of the Services after any changes constitutes acceptance of those changes.

2. Prohibited Conduct

When using the Services, you must not engage in any of the following prohibited activities:

2.1 Unlawful Activities

  • Using the Services for any purpose that violates any applicable local, state, national, or international law or regulation
  • Using the Services to facilitate or promote illegal activities
  • Using information obtained through the Services to engage in unlawful discrimination or violation of fair housing laws
  • Using the Services in connection with any fraudulent or deceptive business practices

2.2 Communications Violations

  • Contacting individuals without obtaining required consents under the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or other applicable laws
  • Sending unsolicited commercial communications (spam) to individuals
  • Using the Services to harass, threaten, stalk, or intimidate any person
  • Making misrepresentations about your identity, affiliation, or the purpose of your communications
  • Failing to honor opt-out or Do Not Call requests

2.3 Data Misuse

  • Scraping, harvesting, or collecting information from the Services through automated means without our express written permission
  • Reselling, redistributing, or sublicensing data obtained through the Services
  • Using data obtained through the Services for purposes other than your legitimate business activities as a real estate professional
  • Attempting to re-identify anonymized or aggregated data
  • Accessing or attempting to access data belonging to other users

2.4 Platform Abuse

  • Attempting to gain unauthorized access to any portion of the Services, other users' accounts, or any systems or networks connected to the Services
  • Interfering with or disrupting the Services, servers, or networks connected to the Services
  • Circumventing, disabling, or otherwise interfering with any security-related features or usage limits of the Services
  • Using any automated system, including robots, spiders, or offline readers, to access the Services in a manner that sends more requests than a human could reasonably produce
  • Attempting to reverse engineer, decompile, or disassemble any portion of the Services
  • Introducing viruses, malware, or other malicious code to the Services
  • Performing load testing or stress testing without our prior written consent

2.5 Content Violations

  • Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity
  • Uploading content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Providing false, inaccurate, or misleading information in your account registration or use of the Services

3. Your Responsibilities

As a user of the Services, you are responsible for:

  • Maintaining the confidentiality and security of your account credentials
  • All activities that occur under your account
  • Ensuring that your use of the Services complies with all applicable laws and regulations
  • Obtaining all necessary consents before contacting individuals using information obtained through the Services
  • Maintaining appropriate Do Not Call and opt-out lists for your communications
  • Independently verifying information before taking action based on outputs from the Services
  • Promptly reporting any violations of this AUP or security concerns to us

4. Reporting Violations

If you become aware of any violation of this AUP or any other misuse of the Services, please report it to us immediately at contact@ervl.com. When reporting a violation, please provide as much detail as possible, including:

  • The nature of the violation
  • The date and time of the incident
  • Any evidence or documentation supporting the report
  • The identity of the violator, if known

We will investigate all reports and take appropriate action. We treat all reports confidentially to the extent possible.

5. Consequences of Violations

Violations of this AUP may result in one or more of the following actions, at our sole discretion:

  • Warning: A written warning describing the violation and required corrective action
  • Suspension: Temporary suspension of your access to all or part of the Services
  • Termination: Permanent termination of your account and access to the Services
  • Legal Action: Referral to law enforcement authorities or initiation of legal proceedings if we believe criminal activity or civil liability may be involved

We reserve the right to take any of these actions without prior notice if, in our sole judgment, immediate action is necessary to protect the Services, our users, or third parties.

Termination of your account for violation of this AUP does not entitle you to any refund of fees paid.

6. Modifications

We may modify this AUP at any time by posting the revised version on our website. Changes are effective immediately upon posting. We encourage you to review this AUP periodically. Your continued use of the Services after any modifications indicates your acceptance of the updated AUP.
